  1. F.S. 120.52(1)(a).
“Agency” means “[t]he Governor in the exercise of all executive powers other than those derived from the constitution.” 2009 to present date, F.S. 120.52 (1) [1](1)  "… the following officers or governmental entities if acting pursuant to powers other than those derived from the constitution:”

Florida Constitution Article II, Section 3:
SECTION 3. Branches of government.—The powers of the state government shall be divided into legislative, executive and judicial branches. No person belonging to one branch shall exercise any powers appertaining to either of the other branches unless expressly provided herein.

 If that police officer came to court I would asked him, what activity was I involved in that authorized you to assert powers not authorized by the Constitution?
If he is representing The Department of Highway Safety and Motor Vehicles, which is a Florida administrative agency which is defined as the governor exercising powers other than those derived from the Constitution, then the police officer is under a presumption that I am involved in some commercial activity.
