FOR THE PAST 16 months the US Dept. of Justice has been arguing in two Supreme Court cases that indictments need NOT contain a certain something, and it has lost to criminal defendants who both had their convictions overturned. This aspect of the crafting of indictments stands to literally empty the prisons, for the US DOJ has been failing to include this essential characteristic for decades.
