A message from somebody who wants to keep you out of prison on tax charges:
Direct quote from DOJ trial memorandum in criminal tax case in Alaska filed Sept. 14, 2014:
“In Cheek v. United States, 498 U.S. 192, 201 (1991), the Supreme Court set forth the following definition: “Willfulness, as construed by our prior decisions in criminal tax cases,
requires the Government to prove that the law imposed a duty on the defendant, that the defendant knew of this duty, and that he voluntarily and intentionally violated that duty.” This same definition applies equally to all tax offenses, misdemeanors and felonies alike. United States v. Pomponio, 429 U.S. 10, 12 (1976) (citing United States v. Bishop, 412 U.S. 346, 359-60 (1973)). “In other words, if you know that you owe
taxes and you do not pay them, you have acted willfully.” United States v. Easterday, 564 F.3d 1004, 1006 (9th Cir. 2009).”
I use only the tools that the US government gives me:
1. They call me a “citizen of the United States.”
2. The IRS has to comply with the Tax Code.
3. To be guilty of tax evasion or failure to file I have to have received gross income.
4. I received gross income in the form of either / both compensation for services / capital gains.
When I “accept” without waiver that these things are true (not #4 above) I can prove that the Tax Code’s never been written to apply to citizens of the United
States, which disposes of capital gains (26 USC § 1(h)), Social Security (26 USC §§ 1401, 3101), and income taxes on my compensation for personal services (26 USC § 1).

My briefed conclusions that the Tax Code’s not written to apply to citizens of the United States and that it imposes no income tax on compensation for services leave the IRS / DOJ wholly unable to prove that any of the “taxes” they demand are actually imposed by law; NOT
GUILTY.
