Somebody explain to me why Obama and Company cannot be held for treason
Last night I watched on Fox News how the military been greatly downsized with the threat of terrorism getting to be an all-time high. With that being said, I came across some interesting law.
CONSTRUCTIVE TREASON. An attempt to establish treason by circumstantiality, and not by simple genuine letter of the law, and therefore highly dangerous to public freedom. 12 C. J. Page 1306.

Constitutional Questions. It is firmly established principle of law that the constitutionality of the statute may not be affected by one whose rights are not affected by the operation of the statute. This rule applies in all cases both at law and equity, and is equally applicable and both civil and criminal proceedings. A constitutional question may not be raised by one whose rights are not directly or certainly affected, nor in any case where no attempt is being made to enforce the provisions attacked. In other words one attacking the constitutionality of the statute must show that the affects him injuriously and actually deprives him of a constitutional right. It is not sufficient that the statute is unconstitutional as other persons or class of persons; it must affirmatively appear that the person attacking the statute comes within the class of persons affected by it. So a party benefited, rather than injured, by the operation of a statute may not question its constitutionality; but a claim that his statue was passed for the benefit of persons of the same class as plaintiff does not preclude him from attacking the constitutionality of the statute where he sets forth a direct and substantial invasion of his constitutional rights. Where the performance of certain acts is necessary to bring a person within the operation of a statute, one who has not performed these acts may not question the constitutionality of the statute. Conversely, any person whose rights are prejudiced by the operation of the statue may raise the question as to its constitutionality. Thus a person may question the constitutionality of a statute the effect of which it is denied him a right that otherwise he would have. …
