This is sort of a challenge to me about me not being a U.S. citizen.  As you can see by the questions and comments it comes from either ignorance or someone has plenty of time on their hands that would rather give me negative reposes of opinions, in lieu of, doing their own due diligence and confirm with facts.

I want to make my position clear, everything I send to anyone is usually sent with the source from where it derived from.  That makes it some much easier for you.  I been to hell and back and spent thousands of dollars and my soul intentions is only to try to inform that American People.  Also, you seeing some of this stuff over and over keeps it in your memory better and help you to understand better as well.

If anyone wants to maintain that they are a U.S. citizen, then a U.S. citizen you are.  I personally do not have a problem with that.  

If you see that I am in error and anyone can back it up with supportive documentation, please bring it on!!!

I am sharing this communication with you for the simple fact this is normal reaction from a lot of people and this is the way that I handle it from time to time.

Well, I have heard chatter about this "distinction" before but I don't see the phrase " U.S. citizen"(he is right) in Constitution, and why would a "federal citizen" necessarily be "domiciled in a territory." (Having a SS# domiciles you in federal territory)  It seems from what I read (emails forwarded) that a US/Federal Citizen becomes a state-citizen of any state in which he choses to reside (domicile),(resident is domicile is not have the same meaning) and there are few "territories" left (since former Western Territories became states).  Why would you say a "federal citizen" be "domiciled in a territory"?(SS#)

 

Question to me: Why do you not want to be a "U.S. Citizen".   Or, are you just saying that you are not one?

Answer: That depends when the question itself provides the clear definition of the U.S. citizen!:

citizen, n. federal citizen. A citizen of the United States. Black's Law Dictionary 7^th Ed

This is why this American is not a U.S. citizen, U.S. Person

Let's define UNITED STATES!

UNITED STATES:

United States This term has several meanings.  It maybe merely the name of a sovereign occupying the position  analogous to that of other sovereigns in the family of nations, it may designate territory over which sovereignty of the United States extends or it maybe collective name for the states which are united by and under the Constitution. (Bk's 4^th)

As quoted right out of the court case:

The term ' United States' may be used in any one of several senses. It may be merely the name of a sovereign occupying the position analogous to that of other sovereigns in the family of nations. It may designate the territory over which the sovereignty of the United States ex- [324 U.S. 652, 672]   tends, or it may be the collective name of the states which are united by and under the Constitution.

 

            a.                  United States or U.S.  The name of the sovereign Nation, occupying the position of other sovereigns in the family of nations. 50 individual states, nations. (Which are foreign to each other)

           b.                  United States or U.S. The federal government and the limited territory over which it exercises exclusive sovereign authority.  NOT the 50 states

            c.                  United States or U.S. The collective name for the States united by and under the Constitution .for, the United States of America. (Which are foreign to each other)

           d.                  United States as a federal corporation. See 28 U.S.C. § 3002(15)(A), NOT the 50 states

To further the understanding the meanings assigned to " United States" by the Supreme Court in Hooven & Allison v. Evatt:

"It may be merely the name of a sovereign occupying the position analogous to that of other sovereigns in the family of nations."

The context in which usually used in the above is International Law; "These united States" when travelling abroad, you come under the jurisdiction of the President through his agents in the U.S. State Department, where U.S. refers to the sovereign society.  You are a "Citizen of the United States" like someone is a Citizen of France, or England.  We identify this version of " United States" with a single asterisk after its name: " United States*"

The context in which usually used in the above is Federal Law and Federal Forms; "The United States ( District of Columbia, possessions and territories)".  Here Congress has exclusive legislative jurisdiction.  In the sense, the term " United States" is a singular noun.  You are a person residing in the District of Columbia, one of its Territories or Federal areas (enclaves).  Hence, even a person living in the one of the sovereign States could still be a member of the Federal area and therefore a "citizen of the United States". This is the definition used in most "Acts of Congress and federal statutes.  This definition is also synonymous with the " United States" corporation found in 28 U.S.C. § 3002(15)(A). We identify this version of " United States" with a two asterisks after its name: " United States**"

"...as the collective name for the states which are united by and under the Constitution."

The context in which usually used in the above is Constitution of the United States; "The several States which is the unites States of America." Referring to the 50 sovereign States, which are united under the Constitution of the United States for the United States of America. The federal areas within these states are not included in this definition because the Congress does not have exclusive legislative authority over any of the 50 sovereign States within the Union of States.  Rights are retained by the States in the 9^th and 10 Amendments and you are a "Citizen of these united States." This is the definition used in the Constitution for the United States of America.  We identify this version of " United States" with three asterisks after its name: " United States***"

 

NOW LET'S TAKE A LOOK AT WHAT CONGRESS HAS DONE TO ENSLAVE THE PEOPLE

The following is the best example of how important is to know the meaning and the intent of the terms, to wit:

Title 26 §3121

(e) State, United States, and citizen

For purposes of this chapter--

(1) State

The term "State" includes the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, and American Samoa.

(2) United States

The term " United States" when used in a geographical sense includes the Commonwealth of Puerto Rico, the Virgin Islands, Guam, and American Samoa.

An individual who is a citizenof the Commonwealth of Puerto Rico (but not otherwise a citizen of the United States) shall be considered, for purposes of this section, as a citizen of the United States.

Amendment XIV of the Constitution for the United States of America:

All persons born or naturalized in the United States, and subject to the jurisdiction thereof are citizens of the United States.

26 CFR. 1 §1.1(c):

(c) Who is a citizen. Every person born or naturalized in the United States and subject to its jurisdiction is a citizen.

Let us break down the definition of each word "Person, Individual, Corporation, State and United States" to see if we can come to an agreement on how this is being applied. 

The origin and constitutionalization of Congress' artificial "person".

On July 1, 1862, when 11 southern states were not represented in Congress due to its Civil War, the remaining members of Congress passed "An Act to provide Internal Revenue to support the Government and to pay Interest on the Public Debt." Therein Congress assigned an artificial meaning to the word "person" as follows.

"And be it further enacted, That on and after the first day of August, eighteen hundred and sixty-two, every individual, partnership, firm, association, or corporation, (and any word or words in this act indicating or referring to person or persons shall be taken to mean and include partnerships, firms, associations, or corporations, when not otherwise designated or manifestly incompatible with the intent thereof,)." Thirty-Seventh Congress. Sess. II. Chap. CXIX. Page 432. Sec. 68. (p. 459.)

My observation here is they did not include the word individual, however keep in mind the definition of the word include therefore; in the present day statutes when they add the term individual, to be included with partnerships, firms, associations, trust or corporations which are all artificial entities it is only natural to assume that individual, is what it is as described below because it is like character. (See below the definition of individual.

Individual: 1. Existing as an indivisible entity. 2. Of or relating to a single person or thing, as oppose to a group.  Blk's Law Dict. 7^th Ed. Pg 777

Entity: An organization (such as a business or a governmental unit) that has a legal identity apart from its members. Blk's Law Dict. 7^th Ed. Pg 553

 

PERSON:

4 U.S.C. §110 Same; definitions

(a) The term "person" shall have the meaning assigned to it in section 3797 of title 26. Brings you to:

26 U.S.C §7701

(a) When used in this title, where not otherwise distinctly expressed or manifestly incompatible with the intent thereof--

(1) Person

The term "person" shall be construed to mean and include an individual, a trust, estate, partnership, association, company or corporation.

26 U.S.C. §7701(a)

(30) United States person

The term " United States person" means--

(A) a citizen or resident of the United States,

(B) a domestic partnership,

(C) a domestic corporation,

(D) any estate (other than a foreign estate, within the meaning of paragraph (31)), and

 

I am an American, born in New York and domiciled upon the  land of Florida.
